GENERAL PROVISIONS
These conditions are valid exclusively between the company Crioterapia.com Italia Srl with registered office in Via Bonaventura Zumbini 29, 20143 Milan, Italy (Tax Code/VAT #IT09709280961) hereinafter referred to as “CRIOTERAPIA.COM” and any person who makes online purchases on the website www.crioterapia.com hereinafter referred to as the “CUSTOMER”.
These conditions may be subject to change and the date of publication of the same on the site is equivalent to the date of entry into force.
These conditions govern purchases made according to the procedure described in this document, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code (Legislative Decree no. 206/2005, amended by Legislative Decree no. 21/2014) and Legislative Decree 70/2003 on electronic commerce.
ARTICLE 1 – OBJECT OF THE CONTRACT
These General Conditions of Sale govern the procedure through which the CUSTOMER can request a purchase proposal for products presented on the site www.crioterapia.com and the subsequent order via personalized quotation.
With these general conditions of sale, CRIOTERAPIA.COM sells and the CUSTOMER purchases remotely the tangible movable goods indicated and offered for sale on the site www.crioterapia.com. The sales contract is concluded with the sending by CRIOTERAPIA.COM of a written proposal (via email or HubSpot system) indicating the price, quantities, payment methods and delivery terms, and the subsequent acceptance by the CUSTOMER.
Before proceeding with the purchase, the user is required to read these General Conditions of Sale, which are generally and unequivocally accepted at the moment in which the CUSTOMER communicates to CRIOTERAPIA.COM his/her wish to proceed with the order.
Users are invited to download and keep a copy of these General Terms and Conditions of Sale. CRIOTERAPIA.COM reserves the right to modify them unilaterally and without notice. Changes will take effect upon their publication on the site.
ARTICLE 2 – PRE-CONTRACTUAL INFORMATION FOR THE CONSUMER
The CUSTOMER has the possibility to view the characteristics of the goods in the product sheets available on the site www.crioterapia.com.
Before accepting the purchase proposal, the CUSTOMER receives the following information:
Total price of the goods including taxes, with details of shipping costs and any other costs;
Payment methods;
The deadline by which CRIOTERAPIA.COM undertakes to deliver the goods;
Conditions, terms and procedures for exercising the right of withdrawal as set out in the specific information attached;
Information that the CUSTOMER will have to bear the cost of returning the goods in the event of withdrawal (except in cases of defect);
Existence of the legal guarantee of conformity for the goods purchased;
After-sales assistance conditions and commercial guarantees provided by CRIOTERAPIA.COM.
The CUSTOMER may at any time and in any case before the conclusion of the contract, take note of the information relating to CRIOTERAPIA.COM:

ARTICLE 3 – CONCLUSION AND EFFECTIVENESS OF THE CONTRACT
The purchase process is started by the CUSTOMER through:
Filling out a contact form on the site www.crioterapia.com; or
Direct communication to CRIOTERAPIA.COM via email at info@crioterapia.com
Following the CUSTOMER's request, CRIOTERAPIA.COM will send a purchase proposal (personalized quote) via email containing:
Description of the requested products;
Unit and total price (VAT included);
Shipping and delivery costs;
Payment methods;
Terms and conditions of delivery;
Link or reference to these General Conditions of Sale and the Refund Policy.
The sales contract is considered concluded when the CUSTOMER, after receiving the proposal referred to in the previous paragraph, communicates his express acceptance (via email, within the HubSpot platform or through other written communication) and proceeds with payment according to the agreed methods.
Upon conclusion of the contract, CRIOTERAPIA.COM will send an order confirmation email containing a unique order number, the CUSTOMER's data, the price of the purchased goods, shipping costs, the delivery address, and a link to view these conditions.
The CUSTOMER undertakes to verify the accuracy of the personal data in the confirmation email and to promptly communicate to CRIOTERAPIA.COM any corrections/modifications to be made.
CRIOTERAPIA.COM strives to describe and present its products in the best possible way. However, some errors, inaccuracies, or small differences between the product depicted on the site and the actual product may occur. The photographs of the products presented on www.crioterapia.com They do not constitute a contractual element, but are to be considered only representative.
CRIOTERAPIA.COM undertakes to deliver the goods within the time frame indicated in the purchase proposal, in any case no later than 30 days from the order confirmation.
ARTICLE 4 – REGISTERED USERS
In completing the registration procedures on the site, the CUSTOMER undertakes to follow the instructions provided and to provide his/her personal data correctly and truthfully.
CRIOTERAPIA.COM assumes no responsibility for the data provided by the user. The CUSTOMER undertakes to promptly inform CRIOTERAPIA.COM of any changes to their data.
If the CUSTOMER provides inaccurate or incomplete data, CRIOTERAPIA.COM will have the right to not activate or suspend the service until the relevant deficiencies are rectified.
Upon registration, CRIOTERAPIA.COM will assign the CUSTOMER a username and password. The CUSTOMER acknowledges that these identifiers constitute the system for validating access to the Services and that any actions performed using such access will be binding upon the CUSTOMER.
The CUSTOMER undertakes to maintain the confidentiality of his/her access data, to safeguard them with due care and diligence and not to transfer them, even temporarily, to third parties.
ARTICLE 5 – PRODUCT AVAILABILITY
Product availability refers to actual availability at the time the purchase proposal is processed by CRIOTERAPIA.COM. However, this availability should be considered purely indicative.
In the event of partial or total unavailability of the goods after receiving the proposal, CRIOTERAPIA.COM will communicate to the CUSTOMER via email the available options (order correction, partial or total cancellation, different delivery date, etc.).
The CUSTOMER must communicate his choice within a reasonable time.
If the CUSTOMER requests cancellation of the order (even partial), terminating the contract, CRIOTERAPIA.COM will refund the amount paid within 30 days from the moment CRIOTERAPIA.COM became aware of the CUSTOMER's decision to terminate the contract.
ARTICLE 6 – PAYMENT METHODS
The payment methods will be indicated in the purchase proposal and may be:
Advance bank transfer;
Check;
Credit Card (via secure payment gateway);
Other modalities specifically agreed upon.
In the case of advance payment (bank transfer or check), the CUSTOMER agrees to make the payment within the deadline indicated in the offer. In the event of non-payment within the agreed-upon deadline (usually 15 days), CRIOTERAPIA.COM reserves the right to cancel the order.
The payment instructions and information entered by the CUSTOMER into the financial circuits (credit card number, security codes) are processed via a connection that uses the SSL (Secure Sockets Layer) protocol and will not be stored on our systems.
ARTICLE 7 – PRICES
All prices listed in purchase proposals are in euros and include VAT. For international transactions, the VAT rate of the destination country will be applied in accordance with current legislation.
Shipping costs are specified in the purchase proposal and are not included in the base price of the products.
CRIOTERAPIA.COM reserves the right to change its prices at any time. However, the goods will be invoiced based on the prices indicated in the purchase proposal sent to the CUSTOMER.
In the event of a computer, manual, technical, or any other error that could result in a substantial and unforeseen change in the sale price (making it exorbitant or clearly negligible), the offer will be considered invalid and canceled and the amount paid by the CUSTOMER will be refunded within 14 days of the cancellation date.
ARTICLE 8 – RIGHT OF WITHDRAWAL
The right of withdrawal is governed by the specific "Refund Policy" attached to this document, pursuant to Legislative Decree 206/2005 (Consumer Code) and subsequent amendments. We recommend that you consult it carefully before proceeding with your purchase.
ARTICLE 9 – DELIVERY
CRIOTERAPIA.COM ships throughout the European Community.
CRIOTERAPIA.COM will only deliver to the CUSTOMER's address provided at the time of the purchase request.
Delivery is generally made within the time frame estimated in the purchase proposal and, in any case, within a maximum of thirty days from the date of order confirmation.
If delivery is not possible, the order will be sent to the warehouse. A notification will be sent to the CUSTOMER informing them of the order's location and how to arrange a new delivery.
If the CUSTOMER is unable to be present at the delivery location at the agreed time, he/she is required to contact CRIOTERAPIA.COM by email at info@crioterapia.com to agree on a new delivery date.
If delivery cannot take place for reasons not attributable to CRIOTERAPIA.COM after thirty days from the date on which the order is available for delivery, it will be assumed that the CUSTOMER intends to terminate the contract.
As a result of termination, all amounts will be refunded, including shipping costs. Shipping costs resulting from termination of the contract may incur additional costs, which will be borne by the CUSTOMER.
Shipping costs are the responsibility of the CUSTOMER and are explicitly communicated in the purchase proposal.
Items purchased on Crioterapia.com may be shipped from distribution centers in Italy or other EU countries.
For each order placed, CRIOTERAPIA.COM issues an invoice for the shipped goods. The invoice is available and printable in the "Order History" section of the CUSTOMER's "My Account" area (if registered), or it can be sent via email to the address provided during the purchase process. The invoice will contain the information provided by the CUSTOMER during the purchase process. Once the invoice has been issued, it will not be possible to make any changes to the information provided.
ARTICLE 10 – LEGAL GUARANTEE OF CONFORMITY
CRIOTERAPIA.COM is responsible for any defects in the products offered, including non-conformity of the items with what was ordered, in accordance with the European Consumer Code legislation.
In the event of receiving defective products or products that do not conform to the order, the CUSTOMER has the right to have the product restored to conformity free of charge through repair or replacement. The CUSTOMER may exercise this right if the defect becomes apparent within two years of delivery of the goods and reports the defect to CRIOTERAPIA.COM within two months of discovery.
In order to exercise the above right, the CUSTOMER must contact CRIOTERAPIA.COM by sending a written communication to the email address info@crioterapia.com containing a detailed description of the defect, photographs, and the original order number.
In the event of a defective or non-compliant product, CRIOTERAPIA.COM will arrange, at its own expense, for the collection of the product, subject to the CUSTOMER's availability.
ARTICLE 11 – COMMERCIAL WARRANTY
In addition to the legal guarantee of conformity referred to in the previous article, all the products presented on the site www.crioterapia.com They benefit from a commercial guarantee whose duration is stated in the product sheets of the items and in the purchase proposal.
To benefit from warranty assistance, the CUSTOMER must keep the original invoice and order number.
ARTICLE 12 – RESPONSIBILITY
CRIOTERAPIA.COM assumes no responsibility for disruptions due to force majeure or unforeseeable circumstances, including those resulting from internet malfunctions, in the event that it is unable to fulfill the order within the timeframe stipulated in the contract.
ARTICLE 13 – DATA PROCESSING
The CUSTOMER's data is processed in accordance with the provisions of the legislation on the protection of personal data, as specified in the Privacy Policy available on the website www.crioterapia.com (in compliance with Legislative Decree 30 June 2003 n. 196 and EU Regulation 2016/679).
ARTICLE 14 – ACCESS TO THE SITE
The CUSTOMER has the right to access the site for browsing and making purchases. Any other use, particularly commercial, of the site or its content is not permitted. All elements of this site, whether audio or visual, and the related technology used remain the property of CRIOTERAPIA.COM and are protected by intellectual property rights.
ARTICLE 15 – COOKIES
The website www.crioterapia.com uses "cookies." Cookies are electronic files that record information about the CUSTOMER's navigation on the site and allow CRIOTERAPIA.COM to offer a personalized service.
CRIOTERAPIA.COM informs the CUSTOMER of the possibility of disabling the creation of these files by accessing their Internet settings menu. Please note that disabling cookies may prevent the CUSTOMER from making online purchases. For more information, please consult the cookies policy available on the site.
ARTICLE 17 – INTEGRALITY
These General Conditions of Sale constitute the entirety of the clauses that comprise them. If one or more provisions of these Conditions are held invalid or declared as such pursuant to law, regulation, or following a decision by a court of competent jurisdiction, the other provisions will remain in full force and effect.
ARTICLE 18 – APPLICABLE LAW AND JURISDICTION
These General Conditions of Sale are governed by and interpreted in accordance with European law, without prejudice to any other mandatory prevailing law of the CUSTOMER's country of habitual residence. The interpretation, execution, and termination of the General Conditions of Sale are subject exclusively to European law.
Any disputes arising from or related to the same shall be resolved exclusively by the European judicial authority. Specifically, if the CUSTOMER qualifies as a Consumer, any disputes shall be resolved by the court of the CUSTOMER's place of domicile or residence, in accordance with applicable law.
